It is possible that something that I said in this connection in my summing up may account for the report which has been made to Your Excellency. While insisting, as I have indicated above, that there was a case of "exciting to crime by the use of the word "kill", I thought the jury would more readily find the prisoners guilty if I dwelt even more on the incitement to tumult and disorder. If they would not do this they would not have found them guilty of the more serious

offence.

With regard to the paragraph of my letter referred to in the Post scrip of Your Excellency's letter, what I meant to indicate was this: There are several degrees of criminality: at the top of the scale would be the man who wrete writes such a poem and actively distributes it: at the bottom the man who merely offers it for sale, by allowing it to be in

his shop. Between these two extremes there are a number of

things which would wore or less aggravate the offence; and there is only a margin of 2 years within which to graduate the punishments. The case put before the Court was the lowest in

the scale, and therefore if the prisoners had been found guilty I could not have imposed a heavy punishment.
